Lawyers
should strictly abide by ethical norms
in their practice. Meanwhile, it is imperative
for lawyers’groups to create a healthy
system to establish lawyers’autonomy
and self-discipline.
To
deal with cases in which the members of
TBA were reported for contravening lawyers’ethics
and discipline, the TBA has enacted the
“rticles of Association of the Ethics
& Discipline Committee of TBA”and “rocedures
for Handling Cases Against Ethics & Discipline
by Members of TBA.”Commissioners of
the Ethics & Discipline Committee are
drawn from among the TBA directors and
supervisors, and, when necessary, from
the general membership. As soon as the
TBA receives a complaint or report regarding
a member violation of ethics or discipline,
an investigative team consisting of three
commissioners conducts an investigation
and presents a report within four months
to the Board for resolution by a two-thirds
vote of those present. For cases involving
non-TBA members who may have incurred
criminal liability under the Law of Lawyers,
the Committee may also take action according
to the same procedures. In all, the TBA
had dealt with total more than 250 ethics
and discipline cases up to the end of
2001.
